Welcome to Novah.

These Terms of Service ("Terms") govern your use of the Novah website and any purchases made through our online store.

By accessing our website or placing an order, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website.

2. Eligibility

By using this website, you confirm that:

  • You will not use this website for unlawful or fraudulent purposes.

3. Products

Novah offers a carefully selected range of women's personal care, hygiene, beauty and lifestyle products.

We make every reasonable effort to ensure product descriptions, images and pricing are accurate.

However:

  • colours may vary slightly depending on your device;

  • packaging may occasionally differ from product images;

  • minor errors may occur despite our best efforts.

We reserve the right to correct errors without prior notice.

4. Pricing

All prices displayed on our website are in South African Rand (ZAR).

Unless otherwise stated, prices are not VAT-inclusive (Novah is not currently registered for VAT).

Prices may change without notice.

The price charged will be the price displayed at the time your order is placed.

5. Orders

Placing an order does not automatically mean it has been accepted.

Your order becomes accepted once payment has been successfully authorised and you receive an order confirmation.

Novah reserves the right to refuse or cancel an order where:

  • payment cannot be verified;

  • fraudulent activity is suspected;

  • products are unavailable;

  • pricing or product information contains an obvious error;

  • circumstances beyond our reasonable control prevent fulfilment.

If payment has already been received, any cancelled order will be refunded using the original payment method where possible.

6. Payment

Payments are processed securely through trusted third-party payment providers, including PayFast and/or Yoco.

Novah does not store your debit or credit card information.

All payment information is processed using secure encrypted payment systems.

7. Shipping

We currently deliver within South Africa only.

Estimated delivery time is generally 8–12 business days from dispatch.

Delivery times are estimates only and may be affected by factors outside our control, including:

  • weather conditions;

  • public holidays;

  • courier delays;

  • high order volumes;

  • strikes or other unforeseen events.

Novah is not responsible for delays caused by courier companies once an order has been handed over for delivery.

8. Delivery

Customers are responsible for providing accurate delivery information.

If an incorrect address is supplied, additional courier charges may apply.

Risk in the goods passes to the customer upon delivery to the supplied delivery address.

Ownership of goods transfers once full payment has been received.

9. Returns and Refunds

Returns are governed by our Returns & Refund Policy.

Nothing contained in these Terms limits or excludes any rights provided to consumers under the Consumer Protection Act.

10. Product Use

Customers must use products strictly in accordance with any instructions supplied.

Novah is not responsible for damage, injury or loss resulting from:

  • misuse;

  • abuse;

  • negligence;

  • failure to follow instructions;

  • use contrary to the intended purpose.

Customers should discontinue use immediately if irritation or an adverse reaction occurs and seek appropriate professional advice where necessary.

11. Personal Care Products

Many products sold by Novah relate to personal care or hygiene.

For health and safety reasons, opened or used hygiene products may not be eligible for return unless required by applicable law or where the product is defective.

12. Promotions and Discount Codes

From time to time Novah may offer promotions, discount codes or special offers.

Unless otherwise stated:

  • promotions cannot be exchanged for cash;

  • only one promotional code may be used per order;

  • promotions cannot be applied retrospectively;

  • promotions may be withdrawn or amended without notice.

Where abuse or fraudulent use of promotions is suspected, Novah reserves the right to cancel the promotion or affected order.

13. Gift Promotions

Where Novah offers free gifts with qualifying purchases:

  • gifts are available while stocks last;

  • substitutions may be made where necessary;

  • qualifying spend is calculated after discounts and before shipping unless otherwise stated;

  • free gifts cannot be exchanged for cash or credit.

14. Intellectual Property

All content on this website, including but not limited to:

  • logos;

  • branding;

  • photographs;

  • graphics;

  • product descriptions;

  • website design;

  • videos;

  • text;

is owned by or licensed to Callous Online (Pty) Ltd and is protected under applicable intellectual property laws.

No content may be copied, reproduced or distributed without prior written permission.

15. Website Availability

We strive to keep our website available at all times.

However, we cannot guarantee uninterrupted access.

We reserve the right to suspend, modify or discontinue any part of the website without prior notice.

16. Limitation of Liability

To the maximum extent permitted by South African law, Novah shall not be liable for any indirect, incidental or consequential loss arising from:

  • use of the website;

  • inability to access the website;

  • delays in delivery;

  • third-party service interruptions;

  • unauthorised access beyond our reasonable control.

Nothing in these Terms excludes liability where such exclusion would be unlawful under South African legislation.

17. Privacy

Your personal information is collected and processed in accordance with our Privacy Policy and applicable South African privacy legislation, including POPIA.

18. Force Majeure

Novah shall not be liable for delays or failure to perform obligations resulting from circumstances beyond our reasonable control, including but not limited to:

  • natural disasters;

  • pandemics;

  • strikes;

  • civil unrest;

  • war;

  • government action;

  • internet outages;

  • courier disruptions;

  • power failures.

19. Governing Law

These Terms are governed by the laws of the Republic of South Africa.

Any disputes shall be subject to the jurisdiction of the South African courts.

20. Changes to These Terms

We may amend these Terms from time to time.

Updated versions will be published on this website with the revised effective date.

Continued use of the website after changes have been published constitutes acceptance of the updated Terms.
